I'm currently trying to make a custom header for my LJ and am not sure which Pros pics I could use for it.
Do I have to do my own screencaps, or are there some available for anyone to use?
I'm not totally sure how all this works, with copyright issues, and such.

Technically, none of us owns any of the images on the icons we make or the caps we grab. Ditto for the pics from the books, magazines, etc. that we post, use and play with. It's all copyrighted material. Making your own screencaps doesn't make a difference. You're still using without permission, if that's what you're asking.

If you want to know if you can use caps or other items, say from my (or anybody else's) LJ or website, then I'd say generally it's considered polite net-etiquette to ask first or at least give proper credit to the person who took the time and trouble to post them. But in the long run, I don't legally own any of the pics I post. Now art from a website or LJ that is created by someone is different. In that case, I believe you definitely need to get prior written permission before you use it. At least that's how I approach this sort of thing.

On my website, I credit people on the main page. On my LJ, I put their name right on the icon when I name it. I don't have any banners on my LJ, but when I do (and I hope to one of these days!), I'll credit it on the user info. It's easier and you can post a link to their LJ or website there, I think.

Tauna's Slashden is great for caps (http://slashden.com/prosP.html) - and I believe she's happy to share. I know I've seen a comment on her site somewhere about using them (I think it was just that credit is nice, which of course it is!) but I can't for the life of me find it right now. She's got a contact-me link if you'd rather ask first though! I know that someone else has recently begun rejuvenating their screencaps site, but I can't remember who that is either... *headdesk*... and then of course you can always google... *g*

As for the pics being copyrighted - well, they are, but I believe the get-out clause is "transformative work", and the fact that we're not making money out of them, just spreading the lurve and continuing to ensure sales of the dvds, so... *g*
